1. Scope of Application
These Terms and Conditions apply to all orders and contracts concluded via the online shop mariadakopoulou.com between Maria Dakopoulou (hereinafter referred to as "Seller") and the customer (hereinafter referred to as "Customer"). Deviating conditions of the Customer shall not be recognized unless the Seller expressly agrees to their validity in writing.
2. Contracting Party and Conclusion of Contract
The purchase contract is concluded with Maria Dakopoulou. The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order. By submitting the order, the Customer makes a binding offer to conclude a purchase contract. The Seller confirms receipt of the order by email. This confirmation of receipt does not yet constitute acceptance of the offer. The contract is only concluded upon dispatch confirmation or upon delivery of the goods.
3. Product Description and Prices
The descriptions and images of the products in the online shop have been carefully prepared. Minor deviations, particularly with handmade jewelry, are reserved. All stated prices are final prices and do not include sales tax in accordance with § 6 Para. 1 Z 27 UStG (Austrian VAT Act), as the Seller is a small business owner within the meaning of the Sales Tax Act. Prices are exclusive of any shipping costs. The Seller reserves the right to change prices at any time. The price stated at the time of ordering applies to the order.
4. Payment Terms
The Customer can choose from the payment methods offered in the online shop. For payment by credit card, the charge is made upon conclusion of the contract.
5. Delivery and Shipping
Delivery is made to the delivery address specified by the Customer. The delivery time is generally 5-7 working days from the conclusion of the contract and receipt of payment. For individually crafted jewelry, the delivery time may be 2-3 weeks. The shipping costs are displayed to the Customer before completing the order and are to be borne by the Customer, unless otherwise agreed. The risk of accidental loss or accidental deterioration of the goods passes to the Customer upon handover to the carrier, freight forwarder or other person designated to execute the shipment.
6. Right of Withdrawal for Consumers
Consumers have a 14-day right of withdrawal in accordance with statutory provisions. The period begins after receipt of the goods and written notice of the right of withdrawal, but no later than 14 days after receipt of the goods.
Withdrawal Notice:
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform me (Maria Dakopoulou, Volkertstraße 4/2/12, 1020 Vienna, contact@mariadakopoulou.com) by means of a clear statement (e.g. by post or email) of your decision to withdraw from this contract.
If you withdraw from this contract, I shall reimburse you all payments I have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by me), without delay and no later than fourteen days from the day on which I received notification of your withdrawal from this contract.
You must return or hand over the goods to me without delay and in any case no later than fourteen days from the day on which you notify me of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You bear the direct costs of returning the goods.
Exceptions to the Right of Withdrawal:
The right of withdrawal does not exist for:
- Goods that were manufactured according to customer specifications (individualized/personalized jewelry)
- Goods that are not suitable for return for reasons of health protection or hygiene (e.g. earrings)
7. Warranty
The statutory warranty provisions apply. For consumers, the warranty period is two years from receipt of the goods. For entrepreneurs, the warranty period is one year. The Customer is requested to check the goods for completeness and obvious defects upon delivery and to notify the Seller immediately.
8. Liability
The Seller is liable without limitation for intent and gross negligence as well as under the Product Liability Act. In the case of slight negligence, the Seller is only liable for breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to foreseeable damage typical for the contract. Liability for personal injury remains unaffected.
9. Data Protection
The Seller processes personal data of the Customer for contract processing and in accordance with the provisions of the GDPR. Detailed information can be found in the privacy policy at https://mariadakopoulou.com/en/policies/privacy-policy.
10. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. The Seller is not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
11. Final Provisions
Austrian law applies to the exclusion of the UN Sales Convention. Place of performance and jurisdiction is Vienna, provided that the Customer is an entrepreneur, a legal entity under public law or a special fund under public law.
Should individual provisions of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.
